Avoiding stress for children should always come first. Separation, divorce or the breakdown of a relationship for an unmarried couple all have the potential to cause considerable distress for any children involved.

When parents in the UK separate, children’s welfare must be a central concern. The Children Act 1989 emphasises that the child’s best interests are paramount in legal decisions. Parents should aim to provide stability, minimize conflict, and ensure consistent communication to protect their emotional well-being. Understanding the child’s needs based on age and maturity is vital, as younger children may require reassurance and routine, while older children may need more input into decisions affecting them.

Mediation is often encouraged to resolve disputes amicably, prioritising co-parenting arrangements that allow meaningful relationships with both parents. The court may intervene if necessary, using Child Arrangements Orders to define living and visitation arrangements. Parents must also consider the child’s financial security and access to education and healthcare. Sensitivity to the child’s emotional responses, including grief, anger, or anxiety, is crucial, with professional support recommended if needed. Prioritising open dialogue fosters resilience during this challenging time.

Avoiding stress for children should be the main priority when it comes to a parental split

Wherever possible we help negotiate arrangements that not only meet the needs of the children but also provide both parents with the means to adjust to their new situation, without undue disturbance. If you and your ex partner are unable to reach an agreement and if the Courts have to become involved we can offer support to assist you in completing the initial application to the Court. This appointment would last for 60 minutes.
