What Legal Aid Doesn’t Cover: Gaps in Access to Justice in the UK
Legal Aid in the UK is designed to help people who cannot afford legal representation, but it does not cover all types of legal issues. Over time, its scope has been significantly reduced, meaning what legal aid doesn’t cover far outweighs what it does, unless exceptional circumstances apply.
One major area not usually covered is most family law matters, particularly those involving divorce, child arrangements, or financial disputes, unless there is evidence of domestic abuse or child protection concerns. This means many individuals must pay privately to resolve what can be complex and emotionally challenging situations.
Legal Aid also generally does not cover employment law cases, such as unfair dismissal or workplace discrimination. People facing issues at work often need to represent themselves in employment tribunals or seek alternative advice services. Similarly, most housing issues are excluded, except where there is a risk of homelessness or serious disrepair affecting health. Routine disputes with landlords, such as disagreements over rent, are typically not funded.
Another key exclusion is immigration cases that do not involve asylum or detention. While asylum seekers may still receive support, many other immigration matters, such as visa applications or appeals, fall outside Legal Aid.
Legal Aid also does not usually cover personal injury claims, as these are often handled through “no win, no fee” arrangements instead. Additionally, consumer disputes, such as problems with faulty goods or services, are not included, leaving individuals to pursue claims independently or through small claims courts.
In some instances, funding may still be granted under the Exceptional Case Funding (ECF) scheme if denying Legal Aid would breach a person’s human rights. However, this is difficult to obtain and not guaranteed.
Overall, while Legal Aid remains an important safety net, its limited scope means many people in the UK must navigate legal problems without financial support.
